NATURE CONSERVATION LEGISLATION


Until recently Protected Areas in Romania have received protection under Environmental Protection Law No. 9/1973 which also stipulated the regulations concerning their conservation and maintenance. This law has now been superseded by the new Environmental Protection Law No. 137/1995.(Law, 137).

The 1995 Environmental Protection Law contains provisions for a Nature Conservation Act, however there appears to be no timetable for preparing the legislation.

The most pressing current requirement is for a Nature Conservation Act to be written which will regulate the institutional arrangements for Protected Areas.


In theory Protected Areas will retain their status under article 54 of the 1995 Act, however the real level of legal protection offered to the existing National Parks and Nature Reserves is unclear and possibly even non-existent (REC, http) and the institutional responsibilities for their administration remain confused.
